EHAP Responds to 2nd Consultation on New PRS Tenancy

The Scottish Government is considering introducing a new type of Tenancy for the Private Rented Sector in Scotland.  We gave our thoughts on the initial Consultation on this back in December of last year.

The Government has since come back with some revised proposals, and we have given our further thoughts on these.  You can download our response to the 2nd Consultation here.

We broadly welcome the move towards allowing at least some judicial discretion on whether to grant Decree for Repossession in some of the proposed new Grounds for Recovery of Tenancies.

The move towards a simplified 'Notice to Leave' is also welcome, as it will alleviate some of the confusion and uncertainty which surrounds the existing processes - for both tenant and landlord.

We await further consultation around the secondary legislation which will need to clarify some of the detail of the new proposals.
